41 (BURNABY) / BRITISH COLUMBIA PUBLIC SCHOOL EMPLOYERS’ ASSOCIATION and BURNABY TEACHERS’ ASSOCIATION / BRITISH COLUMBIA TEACHERS’ FEDERATION It is expressly understood and agreed between the Board and the Association that the terms of this agreement are subject to the provisions of the School Act, the Rules of the Lieutenant Governor in Council and all amendments, regulations, Minister’s Orders,. [. ] The BCPSEA recognizes the BCTF as the sole and exclusive bargaining agent for the negotiation and administration of all terms and conditions of employment of all employees within the bargaining unit for which the BCTF is established as the bargaining agent pursuant to PELRA and subject to the provisions of this Collective Agreement. [. ] Pursuant to PELRA, the employer in each district recognizes the local in that district as the teachers' union for the negotiation in that district of all terms and conditions of employment determined to be local matters, and for the administration of this Collective Agreement in that district subject to PELRA and the Provincial Matters Agreement. [. ] The employer agrees to deduct from the salary of each employee covered by this Collective Agreement an amount equal to the fees of the BCTF according to the scale established pursuant to its constitution and by-laws, inclusive of the fees of the local in the district, according to the scale established pursuant to its constitution and by-laws, and shall remit the same to the BCTF and the local res. [. ] The employer further agrees to deduct levies of the BCTF or of the local established in accordance with their constitutions and by-laws, and remit the same to the appropriate body.
